 Even if someone has extended their lot boundaries through an application under the Boundaries Act, that does not erase historic public use or override shoreline access reservations in Crown patents.

Our Story

  • Crown Patent Reservations Are Still Binding If a patent says: “Reserving free access to the shore for all vessels, boats and persons”…then that reservation is not affected by later boundary adjustments unless the reservation was:
  • • Explicitly revoked by statute
  • • Or released by the Crown (which is rare and would show in title)So even if someone applies to “clean up” or extend a lot line through the Boundaries Act — 
  • if their land originally ended before the shore and public access was reserved, that right survives.
